MORGAN JEWELERS – GOLD BUY Policy & Procedures
GOLD, JEWELRY & PRECIOUS METALS PURCHASE TERMS & CONDITIONSThese Gold, Jewelry & Precious Metals Purchase Terms & Conditions (“Terms”) govern the purchase of gold, jewelry, precious metals, coins, watches, and other eligible items (“Items”) at the discretion of Morgan Jewelers and it’s associates (“Morgan Jewelers,” “we,” “us,” or “our”) from the individual or entity selling the Items (“Seller,” “you,” or “your”).
By presenting Items to Morgan Jewelers for evaluation or purchase, you acknowledge that you have read, understand, and agree to these Terms.
1. ITEMS WE PURCHASE
- Gold jewelry
- Platinum jewelry
- Palladium jewelry
- Gold, platinum, and precious-metal chains
- Rings, bracelets, earrings, pendants, and necklaces
- Watches containing precious metals
- Gold and precious-metal coins
- Broken or damaged fine jewelry
- Scrap gold and fine precious-metal jewelry
- Other items containing recoverable precious metals
2. ITEMS WE MAY NOT PURCHASE
Morgan Jewelers may decline to purchase any Item that does not meet our purchasing requirements. Items that may be refused include, but are not limited to:
- Silver, Plated-silver, Gold-plated, gold-filled, or otherwise plated items when the underlying material does not meet our purchasing requirements
- Precious metal flakes or powders
- Items with altered, removed, defaced, or suspicious identifying marks
- Items for which the Seller cannot satisfactorily establish lawful ownership or authority to sell
- Any other Item Morgan Jewelers determines, in its discretion, is unsuitable for purchase
3. SELLER REPRESENTATIONS AND WARRANTIES
By offering an Item for sale, you represent and warrant that:
- 1. You are the lawful owner of the Item, or you are legally authorized by the owner to sell the Item.
- 2. You have full legal authority to transfer ownership of the Item to Morgan Jewelers.
- 3. The Item is not stolen, lost, misappropriated, pledged, encumbered, leased, or subject to another person’s ownership claim.
- 4. You have not altered, removed, defaced, or intentionally concealed any identifying marks, serial numbers, hallmarks, engravings, or other ownership indicators.
- 5. You have disclosed any known ownership disputes, liens, claims, or other circumstances that may affect your right to sell the Item.
- 6. The information and identification you provide to Morgan Jewelers is true, accurate, and complete.
4. IDENTIFICATION REQUIREMENTS
Morgan Jewelers may require valid, government-issued identification before completing any purchase.
The information collected may include information required by applicable law and Morgan Jewelers’ internal compliance procedures.
You agree to provide accurate information and cooperate with Morgan Jewelers’ identification and transaction-record requirements.
Morgan Jewelers may refuse to complete any transaction if satisfactory identification is not provided.
Must be 18 years or older.
5. INSPECTION, TESTING, AND EVALUATION
Morgan Jewelers carefully examines and evaluates Items before determining a purchase price.
Evaluation process and purchase consideration may include:
- Visual inspection
- Metal surface scratching / penetrating
- Weight measurement
- Verification of engraved markings and stamps
- Electronic and acid metal testing
- Testing for plating or other non-precious-metal materials
- Verification of authenticity
- Determination of precious-metal content throughout entire jewelry, precious items
Testing methods may vary depending upon the Item.
6. DETERMINING THE PURCHASE PRICE
The purchase price offered for an Item is determined by Morgan Jewelers based on verification, authentication, daily gold market and other applicable factors including;- Precious metal type, Karat or fineness
- Actual precious metal content, gram weight
- Current precious-metal market value
- Condition
- Authenticity
- Applicable processing, refining, or other costs associated with refining metals
The purchase price offered by Morgan Jewelers is not necessarily equal to the Item’s original retail price, replacement value, insurance value, appraisal value, or the amount originally paid for the Item.
Gold and precious-metal prices may change throughout the day based on market conditions.
7. GEMSTONES AND DIAMONDS
Unless specifically stated otherwise, any gold buy / precious metals purchased offers will exclude the weight of any gemstone, stone or diamond that is not removed.
Purchase evaluations may deduct gram weight / penny weight if stones are not agreed to be removed before weight evaluation.
Morgan Jewelers may:
- Deduct or exclude stones from a scrap-metal calculation; or
- Decline to purchase stones or Items containing stones.
8. OFFER AND ACCEPTANCE - SELL ACKNOWLEDGEMENT
After completing item(s) evaluation(s), Morgan Jewelers may present the Seller with a purchase offer.
The Seller is under no obligation to accept an offer and has the right to refuse said offer.
If the Seller accepts the offer, valid for that day only, and Morgan Jewelers completes the transaction, the transaction is final, subject to applicable law and any rights that cannot legally be waived. There are no compensation(s) or additional credits given for later fluctuations for change in the gold market, based on a previous precious metal sell.
The Seller should review the transaction receipt and purchase amount before accepting the transaction.
Once an Item has been accepted and payment has been made to seller, the transaction cannot be reversed or returned.
9. PAYMENT
Payments are made in store at the time of the transaction. For amounts over the available amount at any location, Morgan Jewelers will mail a corporate check to the seller for the remaining amount owed.
Morgan Jewelers may limit or refuse the final transaction and payment for any of the below, but not limited to;
- Transaction amounts
- Applicable law(s)
- Fraud-prevention procedures
- Identification concerns or inadequacies
- Internal compliance procedures
10. RIGHT TO REFUSE PURCHASE
Morgan Jewelers reserves the right, in its sole discretion, to refuse to purchase any Item or decline any transaction. The decision to purchase an Item may be based on the assessment and determination of the reviewing Morgan Jewelers associate and may be made for any legitimate business, verification, compliance, or risk-related reason and or otherwise not stated below;
- Inability to verify ownership
- Inadequate identification
- Suspected theft or fraud
- Suspicious or inconsistent information
- Altered or removed identifying marks
- Questions regarding authenticity
- Unacceptable condition
- Insufficient precious metal content or presence of any plating content
- Items outside Morgan Jewelers’ purchasing categories
- Legal or regulatory requirements
Refusal of a transaction does not necessarily mean that Morgan Jewelers has determined that the Item is stolen or unlawfully obtained.
11. STOLEN, LOST, OR DISPUTED PROPERTY
Morgan Jewelers does not knowingly purchase stolen or unlawfully obtained property.
If Morgan Jewelers receiveinformation indicating that an Item may be stolen, lost, misappropriated, or otherwise subject to any ownership dispute, Morgan Jewelers may retain, hold, report, or otherwise handle the Item as permitted or required by law.
Morgan Jewelers may cooperate with law enforcement and other governmental authorities regarding suspected stolen property, fraud, or other unlawful activities.
A law enforcement hold may take precedence over any request by a Seller to reclaim an Item.
12. REQUIRED HOLDING PERIODS
Morgan Jewelers complies with all local and state agency applicable laws and regulations governing purchased precious metals transactions.
13. FRAUD AND SUSPICIOUS TRANSACTIONS
Morgan Jewelers reserves the right to investigate, and report suspected fraud, theft, false identification, fraudulent ownership claims, or other unlawful activity.
Morgan Jewelers may provide transaction records, photographs, identification information, or other relevant information to law enforcement or governmental authorities when required or permitted by law.
Morgan Jewelers may refuse or discontinue a transaction when fraud or other unlawful activity is suspected.
14. PERSONAL INFORMATION
Morgan Jewelers may collect personal information necessary to complete transactions and comply with applicable local laws and regulations.
Information may include identification information, contact information, transaction information, color photographs, signatures, fingerprints, and other information required by law or reasonably necessary for fraud prevention and transaction security.
Morgan Jewelers will handle personal information in accordance with applicable law and its applicable privacy practices.
Morgan Jewelers may collect personal information necessary to complete transactions and comply with applicable local laws and regulations.
Information may include identification information, contact information, transaction information, color photographs, signatures, fingerprints, and other information required by law or reasonably necessary for fraud prevention and transaction security.
Morgan Jewelers will handle personal information in accordance with applicable law and its applicable privacy practices.
15. LIMITATIONS
INothing in these Terms is intended to waive or limit any right, protection, remedy, or requirement that cannot lawfully be waived or limited.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
SELLER ACKNOWLEDGMENT DISCLOSURE
When selling gold/precious metals, sellers must agree to be the lawful owner of the Item(s) being sold.
Morgan Jewelers will inspect and evaluate the Item(s), and I voluntarily accept the purchase price stated on my transaction receipt before accepting any transactions.
IMPORTANT:
Morgan Jewelers may update these Terms from time to time to reflect changes in business practices, applicable laws, regulations, or operational procedures as deemed necessary.
Applicable local agency requirements may change, required transaction forms, registrations, personal identification may be required and held private within our privacy policy. Updated date: 07/01/2026.
